These Buyer Terms govern your purchase or receipt of consumer Requests from HVAC Firms ("Company," "we," "us").
1. Definitions
"Request" means a consumer inquiry submitted through HVAC Firms, including contact information and details about the requested service.
"Buyer" means the business or individual purchasing or receiving a Request.
"Consumer" means the person who submitted the Request.
2. Permitted Use
Buyer may use a Request only to respond to the Consumer's stated inquiry, including providing quotes, scheduling, estimating, clarifying questions, and reasonable follow-up related to that inquiry.
3. Prohibited Use
Buyer will not:
- resell, sublicense, transfer, or disclose a Request to any third party (including other providers, call centers, lead brokers, or affiliates) without Company's written permission;
- use a Request for unrelated marketing, list-building, or adding the Consumer to general marketing lists;
- misrepresent affiliation with Company, the nature of the Request, or the Consumer's intent;
- contact the Consumer in a harassing manner or outside reasonable hours;
- attempt to reverse engineer Company's systems or scrape data.
4. Compliance (Calls, Texts, Email)
Buyer is solely responsible for complying with all applicable laws, rules, and industry standards, including Do Not Call, telemarketing, texting, and email requirements.
Important: If Buyer uses automated dialing, prerecorded/artificial voice, AI-generated voice, or automated marketing texts, Buyer represents and warrants it has obtained any consent required for that specific contact method and seller.
Buyer must promptly honor Consumer opt-outs and suppression requests.
5. Opt-Outs and Suppression
If a Consumer opts out or asks not to be contacted, Buyer must stop contacting that Consumer and must maintain internal suppression to prevent further contact.
6. Data Security and Retention
Buyer must protect Requests using reasonable administrative, technical, and physical safeguards. Buyer must delete or securely dispose of Requests when no longer needed to respond to the Consumer's inquiry and in any event no later than 90 days after purchase/receipt, unless a longer period is required by law.
7. No Guarantees
Requests are provided "as-is." Company does not guarantee conversion, job value, Consumer responsiveness, or outcomes.
8. Credits / Refunds (Optional)
If Company offers credits or refunds, they are governed by any Refund Policy posted on our site. If no Refund Policy is posted, all sales are final.
9. Indemnity
Buyer will defend, indemnify, and hold harmless Company and its owners, employees, and contractors from claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to Buyer's communications, services, or legal non-compliance.
10. Enforcement; Audit
Company may investigate complaints and may suspend or terminate Buyer access immediately for violations. Buyer agrees to cooperate and provide reasonable records related to outreach for the specific Request at issue in response to a Consumer complaint.
11. Governing Law; Venue
These Buyer Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Buyer agrees that any dispute will be brought exclusively in the state or federal courts located in Delaware, unless prohibited by applicable law.
